I recently filed a consumer proposal, and it was rejected. I'm now considering declaring bankruptcy. I own a house assessed at $83,500, and I still owe $71,000. If my trustee doesn't claim it for resale, can the credit union seize it? There are seven of us living there: two adults and five children. According to section 84.2 of the law, it seems to me that this would be impossible. If not, why would it be, and what would happen to us?

If the trustee loses interest in the property, and you are not in default according to the terms of the mortgage, you will be able to keep your house. The potential problem arises if your mortgage needs to be renewed during your bankruptcy.
